David Richards, being a barrister, failed to report promptly or at all to the Bar Standards Board the fact that bankruptcy proceedings had been initiated against him by a petition dated 29 December 2009.

David Richards, being a barrister, failed to report promptly or at all to the Bar Standards Board the fact that a bankruptcy order was made against him on 12 April 2010.

David Richards, being a barrister, engaged in conduct discreditable to a barrister in that between 12 April 2010 and 20 August 2010 he failed to co-operate with the Official Receiver in connection with his bankruptcy.

David Richards, being a barrister, and a circumstance referred to in sub-paragraph 905(b) having been reported to the Bar Standards Board, namely a bankruptcy order having been made against him on 12 April 2010, and having been asked by the Bar Standards Board for comments or information on the matter by letters dated 17 June 2010, 17 June 2011, 8 July 2011, 5 August 2011, 27 September 2011, 21 October 2011 and 19 December 2011, failed to respond promptly or at all to the requests for comments or information, such failure being, by virtue of its combination with another failure or other failures to comply with the Code of Conduct (being the failures which are the subject of Charges 1, 2, 3 and 5 of this Charge Sheet), a serious failure to comply with the provisions of the Code of Conduct within the meaning of paragraph 901.5 of the Code of Conduct, and thereby constituting professional misconduct.
