Past disciplinary findings

In or about September and October 2003 you wrongly represented to a member of the public, Mrs D, that you were a practising barrister or had been a practising barrister in the past, by presenting a business card which used the title ?Barrister,? and/or by way of using words which were reasonably interpreted (and which you knew or ought to have known could reasonably be interpreted) as meaning that you were a practising barrister, and/or by causing to be presented to her a letter from Inner Temple Records Office (dated 30 October 2003) which could reasonably be interpreted (and which you knew or ought to have known could reasonably be interpreted) as meaning that you were a practising barrister. In so doing you engaged in conduct which was dishonest, contrary to paragraph 301(a)(i) of the Code of Conduct, and/or that was likely to diminish public confidence in the legal profession of the Bar or otherwise bring the legal profession of the bar into disrepute, contrary to paragraph 301(a)(iii) of the Code of Conduct. In September 2003 you wrongly represented yourself to Mrs D that you were a practising barrister or had been a practising barrister in the past, in order to induce or persuade her to allow you to become a tenant of one of her properties. You did this by presenting a business card which used the title ?Barrister,? and/or by way of using words which were reasonably interpreted (and which you knew or ought to have known could reasonably be interpreted) as meaning that you were a practising barrister. In so doing you engaged in conduct which was dishonest, contrary to paragraph 301(a)(i) of the Code of Conduct, and/or that was likely to diminish public confidence in the legal profession of the Bar or otherwise bring the legal profession of the bar into disrepute, contrary to paragraph 301(a)(iii) of the Code of Conduct. In the period September to December 2003 you learned that the cheque you presented to Mrs D in September 2003 for ?4,550.00 and dated 19 September 2003 had been dishonoured. Despite learning this you made no attempt or no adequate attempt to pay Mrs D all of the sums owed to her as a consequence of the cheque having been dishonoured. In so doing you engaged in conduct that was likely to diminish public confidence in the legal profession of the Bar or otherwise bring the legal profession of the bar into disrepute, contrary to paragraph 301(a)(iii) of the Code of Conduct. You failed to pay Mrs D sums owed to her arising from your failure to pay her rent in relation to her premises and/or failed to satisfy county court judgments dated 6 July 2004 and 6 August 2004 which had been obtained by Mrs D against you as a consequence of your non-payment of rent. In so doing you engaged in conduct that was likely to diminish public confidence in the legal profession of the Bar or otherwise bring the legal profession of the bar into disrepute, contrary to paragraph 301(a)(iii) of the Code of Conduct.
