Unregistered barristers – you need the Regulatory Update too!

Each month, we send the Regulatory Updateto the entire Bar, including those without practising certificates. Why do we do this? It is because you are still bound by elements of the BSB Handbook. The Core Duties apply if you are providing any legal services. Even if you are not providing legal services the following Core Duties apply:

  • CD5 - You must not behave in a way which is likely to diminish the trust and confidence which the public places in you or in the profession
  • CD9 - You must be open and cooperative with your regulators

The Conduct rules (and associated guidance) which apply to unregistered barristers at all times are as follows:

  • Rule c8 - Your duty not to do anything which could be seen to undermine your honesty, integrity and independence
  • Rule c16 - Your duty to your client is subject to your duty to the court, and your obligations to act with honesty and integrity, and to maintain your independence.
  • Rules c64-70 - Duties in relation to provision of information to the BSB and cooperation with the BSB.These duties include the duty to report serious misconduct by other barristers.
