Code amendments 2009

Changes to the Licensed Access Rules and Recognition Regulations

 

A revised version of Annexe F1 has been issued to reflect that the Bar Standards Board rather than the Bar Council is responsible for the licensed access regime.

The amendments came into effect on 1 November 2009.

 

Implementation of the Bar Training Regulations

 

At its meeting on the 16 July 2009, the Board approved the revised version of Annexe B and amending all references to the "Consolidated Regulations" to the "Bar Training Regulations".


With the introduction of the Bar Training Regulations on the 1 September 2009, the procedures for the registration of European Lawyers transfers from the Consolidated Regulations to the Code of Conduct.

The amendments came into effect on 1 September 2009.

 

Revision of the Adjudication Panels and Appeals processes

 

At its meeting on the 14 May 2009, the Board approved the revised version of Annexe P.


Changes have been made to update terminology, clarify some rules and streamline the processes. Notably the word "hearings" has been changed to "consideration", the section on Investigation and Procedure" has been streamlined to reduce the number of "exchanges" of comments between the parties, provision has been made (Rule 11) for Panels to direct that apologies are approved before being sent to the complainant. Also, a new provision has been added (Rule 15(d) allowing findings to be published in the rare event that consideration takes place in public and Rule 21 includes a provision making it clear that appeals are "rehearings".

The amendments came into effect on 1 June 2009.

 

Implementation of the recommendations of the Strategic Review for Complaints and Disciplinary Processes

 

Following the publication of the Strategic Review in July 2007, changes have been made to the complaints and disciplinary process of the Bar Standards Board. The implementation of these changes requires amendments to be made to Annexe J, K and S and has led to a reissuing of these annexes. These annexes were approved by the Board at its meeting on 8 January 2009.

The amendments came into effect on 31 March 2009.
